No one ever wakes up thinking that they want to possibly spend the rest of their lives in prison, or be put on death row for a crime they may or may not have committed. For defense teams, especially in Capital Death cases, the goal is to give juries reasons to save the client from being put death, and the laws have provided the allowance of mitigation. For me, mitigation is the life-story of the client, whether good or bad, meaning anything and everything that defines who this person is and was, beginning from before they were born to the time they were arrested for their alleged crime, which also includes the time they spend in jail awaiting trial or hoping the case works out. Something happened along their life’s journey that contributed to them getting to a point where they are arrested for their Capital charge(s).
